The Service is intended exclusively for licensed attorneys, paralegals, legal professionals, and their authorized staff engaged in the lawful enforcement of civil judgments. By using the Service, you represent and warrant that:

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at Support@TrackMyDebtor.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized account access caused by your failure to safeguard your credentials.
Data returned by the Service is sourced from third-party public record providers and is provided "as is." We make no representations or warranties — express, implied, or statutory — regarding the accuracy, completeness, reliability, or timeliness of any information provided through the Service. You are solely responsible for independently verifying any information before relying on it for legal, professional, or business purposes.
The Service, including its software, interface design, and content (excluding data sourced from third parties), is owned by the Company and protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose during your active subscription period. You may not copy, modify, distribute, or create derivative works of any portion of the Service.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE COMPANY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO THE COMPANY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.
We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or any applicable law, or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases. You may cancel your subscription at any time by contacting us; access will continue through the end of the current paid billing period. No refunds are issued upon cancellation.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or via a notice within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising under or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to personal jurisdiction in those courts.
These Terms constitute the entire agreement between you and the Company regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver. You may not assign your rights under these Terms without our written consent.
